Terms and Conditions

1. Scope

These Terms apply to all contracts between Patrick Jaritz, sole proprietor (business name “EmployedByAI”, hereinafter the “Provider”), and users of SimVC regarding the use of the service.

2. Service

SimVC is a SaaS application that generates a simulated investor cohort from an uploaded pitch deck and evaluates its reactions (pass reasons, diligence questions, partner-meeting drill). The results are model-based simulations and do not constitute a prediction of whether financing will be obtained, and are not investment, legal or tax advice.

3. Prices and payment

The prices displayed on the website at the time of purchase apply. A free plan is available; paid plans are shown separately. The Provider is a small business under § 6(1)(27) of the Austrian VAT Act (UStG); no VAT is shown. The stated prices are final prices. Payment is processed via Stripe.

4. Right of withdrawal for consumers

Consumers generally have a statutory 14-day right of withdrawal. To exercise it, a clear statement by email to contact@simvc.app is sufficient. The voluntary preparation guarantee under Section 5 remains unaffected.

5. Voluntary preparation guarantee

For a directly purchased “Full Read”, the Provider additionally grants a voluntary preparation guarantee: if the delivered report does not contain at least three concrete deck changes or answers related to the submitted deck for preparing an investor meeting, the user may request a full refund within seven calendar days of delivery of the report by email to contact@simvc.app. Please state the account email address, the run ID, and briefly which parts remained too generic. The refund is made to the payment method used for the purchase. This voluntary guarantee does not limit statutory warranty or other consumer rights.

6. Rights to content

You retain all rights to the pitch decks you provide and to the results generated for you. You grant the Provider the right to process this content for the purpose of providing the service (see Privacy Policy).

7. Liability

The Provider is liable without limitation for intent and gross negligence and under the Austrian Product Liability Act. For slight negligence, the Provider is liable only for breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract. Liability for investment, fundraising or other business decisions based on the simulation results is excluded.

8. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the consumer’s country of residence remain unaffected.
